Travel Services Agreement.

 

For domestic and international travel – sold remotely via www.aljotitravel.com

This Travel Services Agreement (hereinafter referred to as the “Agreement”) is concluded between ALJORY TOURISM TRAVEL AGENCY (hereinafter referred to as the “Company” or “we”), a company officially registered under the laws of the Turkish Ministry of Culture and Tourism, headquartered at İSKENDERPASA MAH. AHMEDIYE CD. No:24, DA:1 FATIH/ISTANBU, TURKEY.

and the Customer (hereinafter referred to as “you” or “your”), who purchases travel services through the website www.aljotitravel.com (hereinafter referred to as the “Website”).

By booking any trip or travel service through the Website, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement.

  1. Definitions

“Travel Services”: includes tours, packages, accommodation, transportation, activities, and other related services offered by the Company through the Website.

“Booking Confirmation”: means the email or electronic document the Company sends to you confirming the details of the travel services you have purchased.

“Distance Sale”: This is the sale of goods or services where the buyer and seller are not physically present in the same location, usually online.

  1. Booking and Payment

2.1. All bookings are subject to availability. 2.2. To confirm a booking, you must complete the booking process on The Website and make the required payment. 2.3. Payment can be made using the methods specified on The Website. 2.4. A Booking Confirmation will be sent to Your provided email address upon successful payment. This confirmation constitutes the formation of the contract between You and The Company.

  1. Prices

3.1. All prices are quoted in, USD

3.2. Prices are subject to change without prior notice until a booking is confirmed.

3.3. Prices include only the services explicitly mentioned in the tour description. Exclusions may include, but are not limited to, international flights (unless specified), visas, travel insurance, personal expenses, tips, and meals not listed in the itinerary.

 

  1. Client Responsibilities

4.1. You are responsible for providing accurate and complete information during the booking process.

4.2. You are responsible for ensuring that You possess all necessary travel documents (passports, visas, health certificates, etc.) required for Your chosen destination(s).

4.3. You are responsible for complying with the laws, regulations, and customs of the countries visited.

4.4. You are responsible for arriving at designated departure points on time.

  1. Changes and Cancellations by The Company

5.1. The Company reserves the right to modify, postpone, or cancel any Travel Service due to unforeseen circumstances, including but not limited to, insufficient participation, force majeure events (e.g., natural disasters, political unrest, pandemics), or operational reasons.

5.2. In the event of a significant change or cancellation by The Company, you will be offered: a) An alternative Travel Service of comparable standard; or b) A full refund of the amount paid for the cancelled service.

5.3. The Company will not be liable for any additional costs or compensation beyond the refund of the cancelled service.

  1. Right of Cancellation by the Client

6.1. The obligatory condition of the consumer to continue the purchased accommodation/service can be canceled maximum 14 days after the reservation date or, in accordance with the same reservation type, the product/service/talk excluding the early reservation and discounted products can be transferred to the requested person or persons. The transferee is jointly and severally liable with the transferor for the balance and all expense areas arising from the transfer. The consumer sends all cancellation / transfer requests to The company in writing and in accordance with the above-mentioned period. If there is less than 14 days between a product imkb and/or reservation and the beginning of the accommodation in the received service campaign area, this article is not transitive. If the person transferring the service/accommodation is not in the same status as the transferee, it will not be realized or the contract will be completed by removing special discounts.

 

6.2. The consumer has requested cancellation up to 30 days before the start of the service, the payment is made to him, excluding the expenses arising from data, fees and similar forbidden burdens that are difficult to pay. The consumer pays 50% of the price he wants to cancel 30-15 days before the start of the service; It completes the imkb that it wants to cancel less than 15 days later, accepts and undertakes to pay to The company. Date changes made by the consumer have been cancelled.

 

6.3. In case of discounted service cancellation/transfer; In case of cancellation/transfer made up to 7 days before the start of the service, the Consumer accepts and undertakes to pay 50% of the service fee, and after 7 days, the entire service fee will be paid by The company. For reservations that close the early reservation process, this agreement is subject to Article 6.1. and 6.2. The periods specified in the Articles of Association are applied only to Consumers who have cancellation insurance, with the right to cancel, up to 72 hours, in the cancellation, change and transfer halls regarding this process.

 

6.4. In the event that the consumer knows in writing the act of service that he has avoided; The company will have the right to cancel all reservations and services after 24 hours from the service start date. In such cases, no three ways are made to the Consumer.

 

6.5. The reservation cancellation request is accepted and the amount paid for the reservation is accepted by the consumer, provided that he or his first-degree relatives have 10 days of comfort to prevent his habitual occupation, an official report from a full-fledged state hospital or a document in case of death. These semi-reports and documents will be submitted before the start of the service. If this situation occurs during the continuation of the accommodation service, the excuse must be submitted to the company with the document within 3 days at the latest from the date of departure from the Hotel. In this case, the days of accommodation service are recorded.

  1. Changes by the Client

7.1. Requests for changes to a confirmed booking (e.g., date change, name change) must be submitted in writing to The Company.

7.2. Changes are subject to availability and may incur administrative fees and/or additional costs charged by suppliers.

7.3. The Company reserves the right to treat a significant change request as a cancellation and re-booking, in which case the cancellation charges (Clause 6.2) may apply.

  1. Travel Insurance

8.1. The Company strongly recommends that You purchase comprehensive travel insurance at the time of booking.

8.2. Travel insurance should cover, but not be limited to, trip cancellation, medical emergencies, personal accident, luggage loss, and repatriation.

  1. Limitation of Liability

9.1. The Company acts as an agent for various third-party suppliers (e.g., airlines, hotels, transport companies, local operators).

9.2. The Company shall not be liable for any loss, damage, injury, delay, or inconvenience caused by the acts or omissions of these third-party suppliers.

9.3. The Company’s liability for any claim arising from this Agreement is limited to the amount paid by You for the specific Travel Service in question.

9.4. The Company shall not be liable for any indirect, incidental, special, or consequential damages.

  1. Force Majeure

10.1. The Company shall not be liable for any failure or delay in performing its obligations under this Agreement if such failure or delay is caused by events beyond its reasonable control, including but not limited to, acts of God, war, terrorism, civil unrest, natural disasters, epidemics, pandemics, government regulations, or industrial disputes.

  1. Force Majeure

10.1. The Company shall not be liable for any failure or delay in performing its obligations under this Agreement if such failure or delay is caused by events beyond its reasonable control, including but not limited to, acts of God, war, terrorism, civil unrest, natural disasters, epidemics, pandemics, government regulations, or industrial disputes.

  1. Complaints

11.1. Any complaints regarding Travel Services must be brought to the attention of The Company immediately during the tour or service delivery to allow for prompt resolution.

11.2. If the issue cannot be resolved locally, you must submit a formal written complaint to The Company within [2] days of Your return from the tour or completion of the service.

  1. Governing Law and Jurisdiction

12.1. This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey.

12.2. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of the city of Istanbul.

  1. Severability

13.1. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  1. Entire Agreement

14.1. This Agreement constitutes the entire agreement between You and The Company regarding the Travel Services and supersedes all prior agreements, understandings, and representations.
